I doubt this helps but some states grant exceptions for cars going under 15mph, making frequent stops, going in reverse, or if there is a note from a doctor.

man i skipped past the 23 responses and didn't read a goddamn thing after reading your initial post but they just changed the law in texas regarding this shit and they're cracking down hard.. HOWEVER plead not guilty, 9 times outta 10 the officer won't show up at the trial, and even if he does, it's heresay and you're probably gonna win....

needless to say my friend is paying that ticket.

You'de be surprised how many messages a day I get on 1911 from people complaining about being negged too much or asking for +rep. It's so fucking annoying, to the point where I often consider just removing the whole rep system so people quit bothering me about it. Moral of the story; If you don't ever bother me about rep, and in general post often and post funny things and gifs, you'll end up with a lot of +rep, regardless of who you are (e.g. #5 milo, lol). Look at alex, I nuked all his rep when he came back on the forums (just to fuck with him). He didn't say shit and just went about posting silly things and sure enough all the bro's +repped him back up again (and I eventually gave him his points back).

Jesus christ I can't believe I've typed this much about fucking rep, go fuck yourselves.

I was actually in the same situation a while back. State trooper wrote me a ticket in the parking lot at work, after I had parked and taken my seat belt off (I had it on when I passed him). The ticket was like $140 total. If i had of gone to court to fight it, and lost; I'd have to pay the fine + court cost which is around $110-$120 + miss a days work...I said fuck it and paid it. If I had money to piss away I would of fought it for the simple fact that I had my god damn seat belt on, and it angers me to no end being falsely accused of something.

So why in a "he said, she said" situation would the word of the officer be any more valid than the word of a citizen? He has absolutely no proof, (badger, your idea if pretty much void, he was traveling perpendicular to me, so there is no way that a forward facing camera would have even seen my vehicle, not to mention they only record when lights or a siren are turned on) Is there some obscure law that says "an officer's word is more truthful than a regular citizen's? I honestly wouldn't be surprised. This is the kind of information I'm trying to dig up before I continue.

Meekrab, I'm going to talk about this option when I call my insurance's legal consultation branch. I am wondering how well this will work though, is my only option to make the argument of ""the necessity of proof always lies with the person who lays charges." whereas the defendant has the "benefit of assumption" ?

Are there any other arguments that you guys would recommend including if I was to do a trial by written deceleration?'

It seems like the burden of proof, and the inability to fairly decide which of the parties is lying, should have it thrown out all together.

I don't know what the situation is down in the States but whenever I receive a ticket, I ALWAYS fight it and get off.

Example:

Dad and I pulling out of gas station wearing no seatbelts crossing one lane of traffic to go the McDonalds drive thru and cop sees us and pulls us over. Dad also didn't have his registration on him as we were going to play ball hockey. Cop is a complete bitch (yes, woman) and we tell her we'll see her in court. She doesn't show up, we get off.

We also have a new system in place to reduce court wait times. Small tickets will allow you to see the court clerk. 15 minutes explaining your situation to him and he throws out the ticket.

All in all, fight the ticket. Always fight the ticket.

If I where you like all cops they have a camera infront of there cars always rolling along with the radar to check peoples speeds. You could always have them look at it, if nothing else works because it would show you having the seatbelt on just before the cop went by. By law they have to show you the footage also, its illigal for them not to.

If your state allows it, do a trial by declaration. Cops don't get paid for those so there's no incentive for him to fill out the paperwork. Then do the delay/extension dance if you somehow lose the trial by mail.

Also possibly contact e`man because I'm pretty sure he's had more tickets than dpk has driver's licenses.

The only people who ever get their rep fucked with (by me at least) are the people who complain about rep in the first place, as it is a totally useless and arbitrary measure on this site. I don't put any time into policing it, and it's supposed to be a joke.

Did I miss the part where you said you were or were not wearing your seat belt? If you were honestly wearing it, I would go to court and tell the judge that, and hope he believes you, all you can do. If you honestly were NOT wearing it, why fight it, you were caught pay the fine. Just my opinion.

His word is better than yours. Your best option is to file for an extension first and then at the end of that file your court date. Very high probability that the officer will not show.

I see no other way to get out of this. Can't beat probable cause!

I'm pretty sure it will come down to a police officer's word against yours which usually never works out. But seeing as how my legal experience consists of jumping fences in order to evade capture when the cops show up, I would spring for a free legal consultation. Most law firms will be able to give you more useful advice to make sure you aren't truly wasting your time/money.

Honestly, your chances of successfully fighting this ticket are very low. Like you said, the judge will most likely go with the officer's word. However, what I know you can do, is reduce the amount on the ticket if not get it dropped. If this is your first offense since your speeding ticket and you plea guilty, I'm sure the judge and prosecutor will at least try to help you out.

Most people don't go to court when they received a ticket, and the ones that do are usually people that think they're innocent and will try to fight it. However, if you go to court, dressed nice (that's also important), and plea guilty it will show that you understand you made a mistake and you're taking responsibility for it. Even if you were wearing the seatbelt, and you have no proof, your best bet is to simply plea guilty.


It isn't much, but you would be surprised how many people go into court looking like they're off the street and start arguing with either the judge or prosecutor, and the amount of people that don't show up is even higher.

I've seen all of that done many times. I have never received a ticket and never had to attend court for myself. But, I have been to traffic courts, landlord/tenant courts, village courts, and several other various courts with real lawyers and I've seen people do all that I mentioned. In most cases, the people that present themselves well are shown compassion and have their ticket either waived or the amount reduced, it depends on how many violations you have on record.

I just got pulled over for a "seatbelt ticket"

an officer in an unmarked police vehicle a block down the road driving the opposite direction claims to have seen me driving without my seatbelt.

Is there any way I can fight this? I know it will likely cost me a shit ton more money than just paying the ticket, but I'm sick of being bullied by highschool dropouts with a badge.

there was no one in the vehicle with me, unfortunately, and I really have no way to prove that I was wearing it. But at the same time he doesn't have any proof that I wasn't wearing it -_- I suppose it would come down to a he said she said sort of deal, is there any way that I can get this thrown out? ( I know that the judge will almost always pick the side of the guy with the badge, but this doesn't seem reasonable to me )

I've already looked around the internet a bit and the only things I've really seen to contest it are claiming that in your current situation wearing a seatbelt would be more detrimental to your safety than if you were wearing it.

I have legal insurance, so tomorrow during their hours I'm going to call for a legal consultation and see what they have to say, but I imagine a few of you must be in law school/practicing law.

Any ideas are appreciated, I'm just so fed up with the legal system. I've been pulled over countless times, and only had one ticket for actually committing a traffic violation (speeding when i was 16)
